This step-by-step guide will help you understand what’s involved in filing a consumer proposal, so you can approach this important decision with confidence.

Step 1: Assess Your Financial Situation

The first step in filing a consumer proposal is to gain a clear understanding of your financial situation. This involves:

  • Listing Your Debts: Gather all the information about your unsecured debts, including credit card balances, personal loans, and any other debts you are struggling to repay.
  • Evaluating Your Income: Review your income sources, including employment income, pensions, or other regular income.
  • Analyzing Your Expenses: Take stock of your monthly expenses, including housing costs, utilities, groceries, and any other essential living costs.

Step 2: Consult with a Licensed Insolvency Trustee

Once you have a clear picture of your financial situation, the next step is to consult with a Licensed Insolvency Trustee firm like C.E. Craig & Associates Inc.

During your consultation our Debt Elimination Manager will:

  • Personalized Advice: You’ll receive personalized advice on whether a consumer proposal is the right choice for you, taking into account your financial goals and ability to make regular payments.
  • Review Your Options: The LIT team will review your financial information and discuss the various debt relief options available to you, including a consumer proposal.
  • Determine Eligibility: The LIT team will assess whether you are eligible to file a consumer proposal based on your debts and your individual financial circumstances.

Step 3: Develop Your Consumer Proposal

If a consumer proposal is the best option for you, the next step is to develop the terms of your proposal. This involves filling in the Application Form, which is used to:

  • Setting Payment Terms: Working with your LIT team, you’ll propose a monthly payment amount that is manageable based on your income and expenses. The payment plan can extend up to five years.
  • Determining Debt Repayment: The proposal will typically involve repaying a portion of your unsecured debts, with the remaining balance forgiven upon successful completion.
  • Drafting the Proposal: Your LIT team will draft the formal proposal document, outlining the payment terms and the total amount you’ll repay to your creditors.

Step 4: File the Consumer Proposal

Once the proposal is developed, your LIT team will file it with the Office of the Superintendent of Bankruptcy (OSB) and all of your creditors.

Filing the proposal initiates the following:

  • Immediate Legal Protection: Upon filing, you are protected from creditor actions, including wage garnishments, collection calls, and lawsuits.
  • Creditor Notification: Your LIT team will notify all of your creditors about the proposal, and they will have 45 days to vote on whether to accept the terms.

Step 5: Creditor Review and Voting

After your proposal is filed:

  • Creditors’ Meeting (if required): In some cases, a meeting of creditors may be called to discuss and vote on the proposal. This happens if more than 25% of your creditors request a meeting or if the LIT deems it necessary.
  • Voting Outcome: For your proposal to be accepted, a majority of creditors (50% plus one, by dollar value of the debt) must vote in favor. If accepted, the proposal becomes legally binding on all unsecured creditors.

Step 6: Begin Making Payments

Once your consumer proposal is accepted by your creditors, you will begin making the agreed-upon payments:

  • Regular Payments: Make your payments according to the schedule outlined in your proposal. We collect initial deposits as a retainer which are then applied to your proposal payments once your proposal is accepted by your creditors.
  • Stop Paying Creditors:  You don’t make payments to your creditors other that what is outlined in your proposal.  These payments are made to us as your LIT, and we will distribute the funds to your creditors.
  • Budgeting Support: We offer or recommend budgeting support and financial counseling to help you stay on track and manage your finances effectively during the proposal period.

Step 7: Fulfill the Terms of the Proposal

Successfully completing your consumer proposal involves:

  • Consistent Payments: Continue making all payments on time as per the agreed-upon schedule.
  • Financial Counseling Sessions: As part of the process, you will attend two mandatory financial counseling sessions to help you develop better financial habits and prepare for life after the proposal.  These can be in person or virtually.
  • Certificate of Full Performance: Upon making your final payment, you will receive a Certificate of Full Performance, officially marking the completion of your consumer proposal.  The balance of your debts are cancelled or written-off by your creditors.

After completing your consumer proposal, it’s time to focus on rebuilding your financial future:

  • Credit Rebuilding: Start rebuilding your credit by obtaining a secured credit card, paying bills on time, and managing your finances responsibly.
  • Monitor Your Credit Report: Regularly check your credit report to ensure that it accurately reflects the completion of your consumer proposal.
  • Plan for the Future: Use the skills and knowledge gained from financial counseling to create a budget, save for future goals, and maintain financial stability.
